TERMS AND CONDITIONS

The following are additional terms and conditions by which EB Sports Tours/Earthbound, Inc. in consideration of a Participant's payment, agrees to provide these travel tours.  Please read these terms and conditions carefully before confirming your reservation.

Reservations:  Payment of deposit must be accompanied by a e-acknowledged reservation where you will have clicked a box to agree to these terms outlined here and below.  DISTRIBUTORS reserves the right to decline or accept retaining any person as a member for the tour at any time or to change or withdraw the tour if necessary.  All prices are subject to change without prior notice to confirmation of order.  Confirmation is e-mailed upon receipt of required payments.  However, if there is future issue with payment, (eg credit card processing difficulties), confirmation may be withdrawn or alternate payment demanded at the sole discretion of DISTRIBUTORS.

Method of Payment:  Payment should be made to your DISTRIBUTORS.  Our intention is to provide you with the event package you have purchased, at the price in effect at the time of the booking.  Payments must be made in the form of credit card only, unless another form of payment is granted to be accepted by the DISTRIBUTORS, on a case by case basis.  A late payment charge of $50 per person may be assessed if final payment is not received by scheduled date.  Provision of credit card number for booking constitutes agreement of all terms set forth herein.  Lead passenger booking packages with this form hereby acknowledges and accepts responsibility for entire group fees and waives chargeback rights on credit card transactions of all cards used to purchase ticket and/or hotel-inclusive packages.

Cancellations and Refunds:  All deposits are non-refundable.  On cancellations received before tour commencement or in the event of a "no show", the total tour price is forfeited.   All final payments are non-refundable and there are no refunds for any unused portion of the tour.  Payments are non-refundable and no refunds or credit will be given for any reason but not limited to the following:  reductions in group size, reservations canceled due to failure of purchaser to comply with the terms and conditions listed herein.  In the event of cancellation or postponement of a certain event, DISTRIBUTORS shall not be responsible for accommodations or transportation beyond the scheduled date of a certain event.  In an event of a reduction in group size, corresponding deposits of canceled passenger blocks are non-refundable and non-transferable (e.g. to the balance of the remaining group).  DISTRIBUTORS reserve the right to cancel, at its sole option, any reservation.   There are a minimum number of tour participants required to operate air-inclusive travel packages.  In the event this minimum level is not reached, DISTRIBUTORS reserve the right to cancel this tour and refund all payments back to Participants.  Participants explicitly agree that DISTRIBUTORS are not liable for any additional costs or fees above this refund.

Changing Your Reservations:  If changes to reservations are allowed in your program, a minimum $25.00 per person fee is charged for any changes made once deposit has been received by DISTRIBUTORS.  Changes must be made no later than 14 days prior to departure dates.  DISTRIBUTORS will do its best to accommodate your needs.

Documents:  When feasible, tour documents are issued a minimum of  3 days prior to departure.  DISTRIBUTORS strongly advises all travelers to obtain medical and cancellation insurance which are available at an additional cost. If you desire, you may purchase travel insurance through our link at Travelex (EB Sports Travelex Insurance) or independently find a travel insurance company on your own. It is your responsibility to discuss options with the travel insurance company directly and pick the insurance package that is correct for you.

Responsibility - Accommodations, Transportation and Services:  In providing this tour, DISTRIBUTORS, through independent third-party suppliers, arranges for certain services and accommodations offered in connection with the tour.  DISTRIBUTORS, its agents, directors and officers and employees shall not be liable for any claims, actions, cause of action, injuries, damages, loss, delays, or expenses arising out of or resulting from any of the following:  Any act or omission of a third-party contractor supplying services on the tour, including, but not limited to air, land or water transportation services, any act or omission of any third party contractor supplying accommodations or event tickets on the tour, quarantine, strikes, force majeure, the failure of motorcoach, water craft or any other means of transportation to arrive or depart as scheduled, disturbances, government restrictions or regulations, discontinuance or change in transit or campground services or any other cause over which DISTRIBUTORS has no direct control.  In the event that the services and accommodations set forth in this package cannot be supplied for any reason, the only obligation of DISTRIBUTORS shall be to use its best efforts to supply comparable services and accommodations within the tour package category chosen.  Grading of services on these tours is in accordance with standard industry practice and you, as a tour participant, accept such grading when booking these tours.  Any refunds and alternate travel arrangements under this contract if any are available are offered with the express understanding that the acceptance of any refund or alternate travel arrangement by you waives any additional claims or remedies.  Please read these conditions carefully.  By submitting payment toward his/her travel, the traveler(s) voluntarily assumes all risks, and is advised to obtain appropriate insurance coverage against them.  Your booking shall constitute a consent to the conditions set forth herein as well as all other terms and conditions of this package and engaging the company, acknowledges these conditions and agrees to hold the company blameless in making the arrangements on his/her behalf, and agrees that restitution or damages, if any are claimed, shall be sought directly from the suppliers.

Tickets to Events:  Generally, tickets to all events will be issued to the Participant before the event date, on-site.  For odd numbers or groups of more than two people, the tickets cannot be guaranteed together.  Nor can specific rows or sections.  Upgraded seating may or may not be available upon request at an additional cost.  In the event of ticket disruption, DISTRIBUTORS' sole responsibility and liability is reimbursement of face value of ticket.
